Pursuant to the Personal Data Protection Act 2010 (“the Act”) that came into force on 15th November 2013, Senada Consulting Sdn Bhd (hereinafter referred to as “Senada”, “our”, “us” or “we”) endeavours to take reasonable precautions and exercise due diligence in ensuring that your personal data is treated in full confidence.

Senada understands that the privacy of your personal data is important to you. As a background screening and verification company, we collect and process personal data to perform due diligence, background checks, and other related services on behalf of our clients. This notice describes the types of personal data we collect, how we may use that data, and the measures we take to protect it. We also explain how you can contact us regarding any inquiries about your personal data.

1. Our Role in Personal Data Processing

Depending on the nature of our engagement, Senada may act as:

  • A Data Controller when we collect personal data directly from individuals.
  • A Data Processor when personal data is provided to us by clients for background screening or HR
    services.

2. Information We Collect

The personal data processed by Senada may include, but is not limited to:

  • Your name, mailing address, phone number, email address, and other contact information;
  • Identification details such as NRIC/Passport number;
  • Information related to your current and past employment history, such as job titles, companies worked for, and dates of employment;
  • Educational background, qualifications, and certifications;
  • Criminal record checks (where applicable and permitted by law);
  • Credit history, directorship information, and regulatory checks (where applicable and permitted by law);
  • References or information provided by referees;
  • Any other information relevant to fulfilling background screening requirements for our clients.

Failure to provide the necessary personal data may result in us being unable to perform the requested background screening services or fulfil our contractual obligations with our clients.

We may combine information we collect about you with other information we receive from additional sources, such as information you may have provided to us by other means or information collected by our employees.

3. How We Use Your Information

We process personal data strictly for legitimate business purposes, which include but are not limited to:

  • Conducting pre-employment screening and background verification on behalf of our clients;
  • Verifying the accuracy of information provided by job applicants, employees, or business partners;
  • Fulfilling client requests related to due diligence and compliance checks;
  • Communicating with you or third parties (such as previous employers, educational institutions, or referees) as part of the verification process;
  • Preparing and delivering background check reports to clients;
  • Ensuring compliance with legal and regulatory obligations;
  • Investigating, preventing, or taking action against illegal activities, suspected fraud, or potential security threats;
  • Improving our screening processes and operational efficiency.

4. Information We Share

We may share your personal data with:

  • Our clients who have engaged us to conduct background screening;
  • Trusted third-party vendors or service providers who assist in verification (e.g., credit reporting agencies, educational institutions, regulatory authorities), provided that such parties are bound by confidentiality obligations;
  • Government or regulatory bodies, when required by law or in response to lawful requests;
  • Other parties, when necessary, to prevent or address security risks, fraud, or legal claims.

We do not sell or trade personal data for marketing purposes.

5. Information Security

Senada implements robust administrative, technical, and physical safeguards to protect your personal data from unauthorized access, disclosure, alteration, or destruction. Access to personal data is strictly limited to authorized personnel who require it for legitimate purposes.

6. International Data Transfer

Where required, personal data may be transferred to clients or verification partners located outside Malaysia. In such cases, we ensure that the transfer is carried out in compliance with the Act and with adequate protection measures in place.

You have the right to request access to and correction of your personal data held by us, subject to applicable legal restrictions. You may also request to limit the processing of your personal data. To exercise these rights, you may contact our DPO at ask.pdpa@senadaconsulting.com. We may refuse to comply with your request for access or correction to your personal data under the Act and if we refuse to comply with such request, we will inform you of our refusal and reason for our refusal.

This policy may be updated periodically to reflect changes in our services, legal requirements, or privacy practices. The latest version will always be available on request or through our official communication channels.
